عقد فروقات

أي عقد للفروقات أو أي عقود أخرى يكون هدفها الصريح أو المقصود تأمين تحقيق ربح أو تفادي خسارة ناتجة عن تقلبات في: 1" قيمة أو سعر ممتلكات مهما كان وصفها. 2" أو مؤشر أو عامل آخر جرى النص عليه لذلك الغرض في العقد. ويستثنى من ذلك: 1" الحقوق بموجب عقد إذا كان الأطراف يهدفون إلى تأمين ربح أو تفادي خسارة لطرف واحد أو أكثر يتسلم أي ممتلكات يكون العقد متعلقًا بها. 2" الحقوق بموجب عقد يتم بموجبه استلام أموال على سبيل الوديعة حسب شروط تنص على أن أي عائد يتوجب سداده على المبلغ المودع يحسب بالرجوع إلى مؤشر معين أو عامل آخر. 3" والحقوق المترتبة على عقد تأمين.

Any contract for differences or any other contracts the purpose or pretended purpose of which is to secure a profit or avoid a loss by reference to fluctuations in: 1" the value or price of property of any description; or 2" an index or other factor designated for that purpose in the contract; but excluding: 1" rights under a contract if the parties intend that the profit is to be secured or the loss avoided by one or more of the parties taking delivery of any property to which the contract relates; 2" rights under a contract under which money is received by way of deposit on terms that any return to be paid on the sum deposited will be calculated by reference to a specific index or other factor; and 3" rights under a contract of insurance.
